Australian Immigration – new occupation lists from 19 April 2017

From 19 April 2017, the Australian Government has revised the occupations lists for the Employer Sponsored Temporary subclass 457 visa and Permanent subclass 186 and 187 visas.

The existing Consolidated Skilled Occupation list (CSOL)  has been replaced with two new lists,

  • Short-term Skilled Occupation List (STSOL)
  • Medium and Long-term Strategic Skills List (MLTSSL)

There has been a removal of 216  occupations against the original CSOL list. A further  59 other occupations have had restrictions imposed specific to the occupation.

New Occupation Lists

The new lists will be updated every 6 months in line with the Department of Employment’s guidance and contain the  following:

Short-term Skilled Occupation List (STSOL)

This list consists of occupations that may require employers to hire temporary migrants to fill labour gaps that are only required short-term.

This visa has a validity period of 2 years with an option for one extension of a further 2 years.

There is no pathway to a permanent visa

Medium and Long-term Strategic Skills List (MLTSSL)

This list includes occupations that have been assessed as being of high value to the Australian economy and aligning to the Government’s long-term training and workforce strategies.

This visa has a validity period of 4 years. There is a pathway to a permanent visa either through the Direct or Temporary Residency Transitional Stream

Pending nominations as of 19 April 2017

The new legislative changes to the occupation lists applies retrospectively, meaning that all pending Subclass 457 Visa nominations in the removed occupations will not be approved.The Department are requesting sponsors to withdraw those applications to obtain a full refund.

Where the nominated occupation now has a  specific caveat attached, we would ask that Sponsors review whether an exclusions apply to their position which may mean a refusal unless the nomination is withdrawn earlier.
